Can you download Newer Super Mario Bros DS for DSI ( have a Internet Browser) at Release or only on 3ds?

You can download and play it off an R4 or other similar carts, but you can't patch/install the game directly from the dsi web browser, if that's your question.

Will there be shops like in Newer Wii? Not just the blue mushroom house after you beat the game.
