I was going to say something similar. Now I am not trying to be offensive but it feels like you saw footage of NewerSMBDS and felt like copying it. Almost all the words are similar:

Only one world is changed but the rest are similar to NewerDS's Worlds.
Also many levels also have the same theme. I'd be fine if it is just for one world, but 7 or 8 of them!?

1-Castle:


This looks almost the same as the World 1 Castle in Newer DS (Slightly Different and with probably my BG)
Even the name isn't good. The logo also looks like you slapped a word on it and stretched it. Now the hack could be good, but the similarities are there. Inspriation is fine, but it looks more like a copy rather than a homage.

The World 1 and 8 icons look awfully familiar to NerDS.

but to be honest, it's not exactly wrong to use the same icon. Same with the world name.

You can't copyright a simple world name. So he can still use the name he gave to that world. It's not the best idea, but it's not illegal.

Technically he could take Newer DS whole and claim as his, and I couldn't legally do anything about it, which makes that point a bit moot

But the icons aren't exactly the same, either. Can't do anything about that.

However if the work is legit the same exact thing, down to every single byte, sure. You can claim plagiarism. But this case is just unoriginality.

I'd disagree; if you write something (let's say an essay for school for an example) by essentially rewriting some other, original work, while keeping the ideas and content the same, even if every single word inside is different and yours, it still counts as plagiarism.

I had a friend who failed a class like that.

And while this perhaps doesn't escalate to that level, his insistence that everything is his original idea does make what I wouldn't care about at all into something that slightly annoys me.
