You either have a bad rom or a bad patch then. Also be sure that the region of the rom you are using is the same as the region of the patch.

How do I check the patch's region / know if its a bad patch or rom? (if there is a way)

The region the patch is for is probably stated in the thread of the hack. If not, the standard arround here is the US version.

If you are sure the patch and rom regions are the same and it still won't work the patch itself is broken. In that case just ask in the hack's thread

You can't convert it to xdelta. To apply nmp patches, use nsmbe.

I'd say a patch should be 100% legal as long as you used your own ripped copy of the original game from a homebrewed DS/3DS. As long as the patch isn't identical or close to the original game (Like I see some hacks on here.) then it shouldn't be illegal whatsoever.

Patches usually contain quite a bit of copyrighted content which is illegal to share. Simply take NSMB for instance. The first thing that happens for every NSMB hack is that Overlay 0 gets decompressed. It's something the editor has to do. The original NSMB has a compressed Overlay 0 though, so what does this mean? Every NSMB xdelta patch ever contains a copy of a decompressed Overlay 0, which contains copyrighted data. That's not the case with NMP patches though, since they don't contain any code files. Most of the time though, they don't need to. Using any asset from another game is enough, since you do not have ownership of the asset. NSMBW and NSMBU tilesets are probably the most common example of this.

xdelta should really xor the output patch with the original rom file.

That way there would be no original data that could possibly be extracted from the patch without having the original file.

Well Nintendo is very busy with the switch and the Nintendo DS has been forgotten, and NSMB too, people like NSMBW more, and Nintendo is only looking for money, you think they would lose interest in NSMB?

It depends really. Nintendo could eventually remake older NSMB games for the newer consoles for whatever reason. They've been remaking and releasing games like crazy the past few years. NSMBU, Luigi's Mansion, SM3DW and other 3D Mario games.

you're right about that, but there are many hacks, but after all a remake is a remake, I don't think they have to do with what happened to the DS, they just remake it and voila, or they think that Nintendo would give interest to the game NSMB for DS at another time and see how it is, the Nintendo DS has not been sold for some years, and Nintendo I do not think it would have to be willing to see if there are hacks of this or not, since when making a reamake or port newer they will steal public, and they would win anyway since that would be newer and if they emulated it in switch is the same
