There are a number of commercial ROMs on the uploader that should not be there. A simple way to locate them is to search for ".nds" (CTRL + F) in the Levels/Hacks, Images and ASM Hacking sections.
These ROMs will be deleted on August 31 1pm UTC. In case anyone wants to archive all of these ROMs by turning them into patches or otherwise, please download them before then. Thank you. |

Thanks for pointing this out.
I would suggest archiving the ROMs elsewhere than just the Internet Archive though, in case Nintendo has some tasty DCMA claims up its sleeve involving .nds files on the archive. |

Interestingly, archive.org has a DMCA exemption on computer/console software if it isn't being distributed via official means in any way anymore.
If I'm not wrong, there's no official means of buying the original game anymore (due to the WiiU VC store shutting down and the DS being discontinued years ago), and even on the WiiU VC, the ROM-image wasn't identical to the original one anyway. Nintendo can file a DMCA complaint against archive.org if they so please over it but given this I suspect it wouldn't go anywhere unless you're trying to upload Switch games or something

The ROM in the WiiU VC probably has [insert change here that reduces risk of seizures].
Also I somehow doubt that Virtual Console has an entire ROM format dedicated to itself, or if it is it's not something too trivially different from the typical format(s). Could be wrong here though. Most of the emulator work on Nintendo's end these days is done by NERD, who are also known for their unrivalled love of Lua, so maybe these days they just patch in these changes on the fly knowing them. |
