It does not actually crash, it goes out of sync: different things happen on different DS's.
But yea, the result is kinda the same. You don't want either of the things to happen

Perhaps in the future we can change the number of players in multiplayer ... although it is too early to think about that ...

It's absolutely not possible to get more than 2 players
The NSMB's code is full of static arrays of size 2. It's impossible to resize them because there's more data after them. To resize them, they'd have to be allocated somewhere else, and all the references changed. It's impossible

And I'm pretty sure the wifi code is also designed for 2 players only

Ou ... With the progress of the community is impossible , BUT ANYTHING IS POSSIBLE (Someday), if Nintendo could do this, someday we will ....
